ORDER
Decree Holder produced a speaking order from the Hon’ble State Commission in Revision Petition No. 59/2014. As per the order “on appeal the question whether the opposite parties had made the vehicle roadworthy or not is something to be decided by the execution court and not dependent on the satisfaction of the complainant. So from the evidence available before the execution court if it appears that the opposite parties had made the vehicle reasonably roadworthy, there is no other option for the complainant but to accept the vehicle and the Consumer Forum in that case close the E.P as fully executed”.
In this E.A, a commissioner was deputed to verify whether the vehicle is roadworthy and the commissioner reported that the vehicle is very good technically. The entry of new block number and the variation on the entry of chassis number need to be endorsed on the R.C Book. For that, R.C owner need to give application to the concerned registering authority. No objection in the final commission report filed by both parties. Hence commission report remained unchallenged and this Forum is satisfied that the vehicle is roadworthy and Decree Holder is directed to accept the vehicle and approach the concerned registering authority to correct the block number and chassis number by filing necessary application. E.A closed as fully executed.
