ORDER
The Complainant in his complaint has stated that he was lured to take Insurance Policy of OP (Policy No. 71169380 on 26th November, 2019) by their representatives namely one Mr. Mukesh Sharma & Mr. Ved Parkash as they told him that he will get interest free loan as well as commission on this Policy and when he received Policy Verification Call from OP then as per advice of these alleged representatives, he gave answers in affirmative as ‘Yes’ and ‘OK’ and Policy was issued to him. However later on when tried to contact these persons there was no response from them.
Complainant has also stated that in fact he bought 12 such Policies of OP and when realized that he was cheated then he filed complaint before Ld. Insurance Ombudsman. Though his 11 Policies were cancelled by the Order of Insurance Ombudsman however the Policy as mentioned in his present complaint was not cancelled. He has enclosed copy of the Award past by Ld. Insurance Ombudsman dated 30.03.2021 wherein his request for cancellation of this policy was rejected on the ground that he participated in the pre-insurance ‘Video Verification Call’ and ‘Welcome call’ and he did not raise any concern amount of the bonus during these calls and he voluntarily ignored all the precautions against any mis-sale of Policy issued to him.
In the complaint filed before this Commission nowhere he has alleged any ‘deficiency of service’ on the part of OP and has rather based his complaint on fraud angle which cannot be subject matter of adjudication before this Commission.
Further this Commission also does not sit as Appellate Authority against the Order/Award passed by the Ld. Insurance Ombudsman.
In the view of the above, this Commission holds that the complaint file by the complainant is not maintainable under the provisions of Consumer Protection Act, 2019 and it is ordered accordingly.
The complaint is not maintainable.
