Present: Smt.Saroj Rani Gupta, complainant No.2 in person with her counsel

Sh.Yashwant Rai Puri.

    Sh.Rishi Kant Arora, counsel for opposite party No.1.

    Opposite party No.2 Ex-parte.


 

    The complainant has filed the present complaint claiming a sum of Rs.97,131/- alongwith interest, compensation and costs of litigation from opposite parties.

However, Sh.Rishi Kant Arora, counsel for opposite party No.1 has suffered statement to the effect that as per instructions of his client, he offers to pay a sum of Rs.95,000/- in full and final settlement of all the claims and demands of the complainant in the present complaint. The bank details/NEFT details of the complainant No.2 have been received today and payment shall be made within a period of 45 days.

Smt.Saroj Rani Gupta, complainant No.2 in person with her counsel Sh.Yashwant Rai Puri has also suffered a statement that she accepts the abovesaid offer given by opposite party No.1. Therefore, this complaint may be disposed off accordingly.

In view of the statements made by counsel for opposite party No.1 and complainant No.2, the present complaint is disposed off with a direction to opposite party No.1 to pay a sum of Rs.95,000/- in the bank account of the complainant No.2 within 45 days from the date of receipt of certified copy of this order, failing which the awarded amount of Rs.95,000/- shall carry interest @ 9% per annum from the date of discharge of the complainant No.2 on 19.03.2024 from the hospital of the opposite party No.2 till actual realization. Certified copy of this order be supplied to the parties free of costs as per rules. File be indexed and consigned to the record room.
