O R D E R

Since efforts for settling the dispute amicably were already underway, so finally the same has happened today and as a result thereof instead of addressing arguments learned counsel for both the parties has suffered a joint statement that the matter has amicable been settled between both the parties. As per the settlement respondent No.1/opposite party No.1 i.e. Iffco Tokio General Insurance Company Limited will pay to the appellant/complainant i.e. Mr. Balkar Singh, the complete IDV of the vehicle i.e. Rs.42,100/- (Rs. Forty two thousand one hundred only) along with compensation of Rs.10,000/- (Rs. Ten thousand only) and litigation expenses of Rs.5500/- (Rs. Fifty five hundred only) as awarded by learned District Commission in full and final settlement of the entire claim in the complaint and the appeal after deducting amount if any, already received by the appellant in pursuance of the award of learned DCDRC. The aforesaid amount shall be paid by the insurance company after the transfer of the vehicle in question by the appellant in the name of the insurance company and deposit of its salvage by appellant with the insurance company as per the direction of the learned DCDRC in the award. Hence, the present appeal may be disposed of in view of the aforesaid settlement. Their joint statement in this regard recorded separately.
2. In view of the above stated joint statement, as the dispute in question has been settled between both the parties, the present appeal is hereby disposed off accordingly. Needless to say that both the parties shall remain bound by their respective statements.
3. A copy of this order be provided to all the parties free of cost as mandated by the Consumer Protection Act, 2019. This order be also uploaded forthwith on the website of the Commission for the perusal of the parties.
4. Application(s), pending, if any, stand disposed off accordingly in terms of this order.
5. File be consigned to record room alongwith a copy of this order.
