This is a petition No. 1820 dtd. 13.3.23 filed under Order 23 Rule (1) of C.P.C. It is submitted in the petition that opp.party have issued a cheque amounting to Rs.65,000/- (Rupees sixth five thousand)only bearing cheque No. 5108 dtd. 10.12.22  of  HDFC Bank as per terms and condition of an agreement No. 10/A-3 dtd. 10.12.22. This cheque was duly encashed  by the petitioner and as such  they pray for disposal of the matter before this commission and complainant wants to withdraw the instant complaint. The petition is supported by the affidavit sworn by the complainant . Similarly the opp.party  , IFD Industry  filed a petition no. 1821 dtd. 13.3.23 stating the fact as stated above in the earlier petition and opp.party  confirm the fact that there is no difference between  the parties as matter of dispute has been settled outside the commission and pray for dismissal of the case on withdrawal.

            Accordingly  after due hearing, the case is disposed of on withdrawal and dismissed as the settled amount has already received by the complainant as mentioned in his petition.
