ORDER

Heard the counsel for the complainant, also complainant and counsel for opposite party with regard to the proposal of settling the dispute between the parties. The complainant who is in person submitted for replacement of the old washing machine with a brand new washing machine with a fresh warranty to the new machine. But, the counsel representing the opposite party though agreed for replacing the old washing machine with a brand new, but he did not agree for warranty for the entire period and submitted that order may passed accordingly. Then we prevailed upon the counsel for the opposite party to see that warranty is given for a period of one year from the date of supply of the machine and replace the old one with a new one, the complainant at that stage submitted for directing the opposite party to extend the benefit of extension of warranty for another one year on payment. As that do not arise for consideration at present, the complainant may contact the opposite party for extended warranty on payment at the appropriate stage, then the opposite party shall consider the request of the complainant and do the needful. With this the complaint is disposed of in the following terms: 1. The third opposite party shall replace the old washing machine with a new washing machine of the same brand and same capacity within 10 days from 03.03.2009 and at that time, the complainant shall hand over the old washing machine to the third opposite party with all its accessories. 2. The third opposite party shall also give warranty for a period of one year from the date of delivery of the new machine. 3. In the event of third opposite party failing to replace the old washing machine with a new one as ordered above shall refund Rs.25,000/- being the cost of the washing machine with interest at 8% -p.a. from the date of this order till the date of payment. 4. Parties to bear their own costs. 5. Give a copy of this order to both parties.
