Today is fixed for admission hearing.

Ld. Advocate for the complainant is present. Heard Ld. Advocate for the complainant on admissibility of the Consumer Complaint. Considered.

It appears from the Consumer Complaint that the complainant have filed the case on 05.06.2024 against the OP IDEAL Heiths Pvt. Ltd. for deficiency in service with the payer for passing an order directing the OP to deliver the possession of the flat along with car parking in question and also to execute and register the Deed of Conveyance in favour of the Complainant and compensation of Rs.15,00,000/- and litigation cost of Rs.10,00,000/-.

No copy of Agreement for Sale has been filed by the complainant in the instant case for adjudication of the matter and due to want of this agreement, we are not inclined to admit the Consumer Complaint in its present form and as such same is rejected.

However, the complainant is at liberty to file afresh with cover up the above observation on the same cause of action, if so advised, and if not, otherwise barred by law.
