Today, the case is fixed for reporting of compromise. The learned counsel for opposite party No. 1 – insurance company has made a statement recorded separately that till date, no claim has been registered with the insurance company qua the subject matter of the complaint and the complainant may be directed to lodge the claim with the insurance company. Learned counsel for the complainant has also made a statement that since no claim has been registered till date, the complainant will lodge the claim with the insurance company-OP No. 1 afresh and the insurance company in turn be directed to decide the claim within stipulated period, upon receipt of documents. In case, the insurance company fails to decide the claim within stipulated period, appropriate cost may kindly be assessed by this Hon'ble Commission.

In view of the aforesaid statements of learned counsel for the parties, the complaint stands disposed of with the direction to the complainant to lodge the claim with opposite party No. 1 – insurance company within 7 days from today and opposite party is directed to decide the claim of the complainant within 30 days after lodging of the claim by the complainant. However, the parties shall remain bound by their statements. File be consigned to the record.
