Complaint under Section 35 of Consumer Protection Act.

Present:     Shri R.K. Kamra, counsel for complainant.

         

          Today the case was fixed for consideration on the point of maintainability. Learned counsel for complainant appeared and suffered his separate statement to the effect that he does not want to pursue with the present complaint and withdraws the same on account of technical defect and sought permission to file afresh before the competent Court.

                In view of statement of learned counsel for complainant, the present complaint is dismissed as withdrawn. However, the complainant would be at liberty to file fresh complaint on the same cause of action in the court of competent jurisdiction. File be consigned to the record room after due compliance.
