CC No.40 of 2022.

M/s Bikaner Misthan Bhandar vs. ICICI Bank.

 

Present:   Complainant with Sh.Satish Kumar, Adv.

                (Notice of complaint was not ordered against opponent No.1).

                Sh.KK Gupta, Adv. for opponent No.2.   

 

             On the intervention of this Commission, parties have entered into amicable settlement, according to which, the opponent No.2 agreed to make payment of Rs.41539.22ps to the complainant within the period f 20 days from today, subject to return of Swipe Machine by the complainant to the opponent. Statement of counsel for opponent No.2 recorded.

               The complainant who is present before this Commission, agreeing to the statement of counsel for the opponent No.2.  Statement of the complainant also recorded.

              Keeping in view the statements of the counsel for opponent No.2 and complainant, without making any adverse comment on the act and conduct of the opponent No.2, matter being amicably settled, the complaint is accepted against the opponent No.2, holding it liable to make the payment of Rs.41539.22ps rounded it Rs.41540/- to the complainant within the period of 20 days from today.  In default of the opponent No.2 shall be liable to pay simple interest @8% p.a. from the date of order till actual realization. However, it made clear the complainant will return the Swipe Machine to the opponent at the time of taking the award amount.  File be consigned to the record-room.
