1.      Counsel for the petitioner heard. This is a case of a defective car.  It is alleged that there was mechanical defect in the car of the complainant Sh. K. Muthuswamy.  For the following reasons we dismiss the Revision Petition:

i)        First of all the car has been used for nearly two years.

ii)       It has already been run for 18,056 kilometers without any defect.

iii)      It also transpired that the vehicle was driven without proper coolant and therefore, the radiator became faulty which caused repairs and also the complainant used water instead of coolant and did not follow the instructions given in the guidelines for maintenance of the car.

iv)The vehicle is already lying with the Hynduai Motor India Ltd. in their service station. According to the respondent/opposite party, it has got no defect.  The complainant has not taken back the car from the service station. 

2.      It is difficult to fathom how he can say that the car is still defective.  If advised, he can take back the car, find out whether is any defect or not, and if necessary, he may again approach the Consumer Fora.

3.      Dismissed.
