ORDER
By G.Yadunadhan, President:
The case of the complainant is that complainant had purchased two Railway tickets for traveling from Kozhikode to Trichur through E.Ticketing facility. Ticket received from the opposite party, instead of paying the ticket fare extra Rs.100/- demanded by the opposite party. This act is deficiency of service and unfair trade practice from the side of the opposite party. Therefore complainant is seeking relief against opposite party directing them to return the excess ticket fare and also pay compensation of Rs.500/-
Points for consideration
- Whether any deficiency of service on the part of opposite party?
- Whether complainant is entitled to get any compensation? If so what is the relief and cost?
Opposite party after serving notice not appeared or filed their version. On perusal of document and the complaint , no evidence to show that opposite party demanded more than the actual fare of the ticket. Complainant was continuously absent for the last 3 consecutive postings, since there is no document or oral evidence Fora can not go beyond the complainant, no merit in this complaint. Therefore complaint is liable to be dismissed.
Pronounced in the open court this the 12th day of March 2014.
Date of filing 05/11/2013.
