1]                   Left with no alternative, the complainant sent a legal notice dated 15.5.2013 to the OPs through post (Ann.C-5 to C-10), but the same was not replied.

5]               The representative of OP No.2 handed over the handset to the complainant after software update.

7]             . The complainant has been making visits to OPs NO.2 & 3 time and again with these defects, as per details Ann.C-2 & C-3, but finally he could not get his handset back.

i)        To provide a brand new mobile handset having the purchase value of Rs.16,400/- on the date of filing of the present complaint i.e. 25.1.2013 or to refund the amount of Rs.16,400/- to the complainant along with interest @9% p.a. from the date of purchase of the handset i.e. 25.1.2013 till realization.

ii)       To pay a sum of Rs.7000/- to the complainant on account of unnecessary mental agony and harassment suffered by the complainant.

iii)     To pay a sum of Rs.3000/- towards litigation expenses to the complainant.
