          Shri Deepesh Joshi, learned counsel for the appellant.

            Shri Nishant Goyal, learned counsel for the respondent.

 

As per Shri Justice Shantanu S. Kemkar :                       

            This appeal has been filed under Section 15 of the Consumer Protection Act, 1986 (For short ‘Act’) by the complainant challenging the order dated 22.04.2009 passed by the District Consumer Disputes Redressal Forum, Indore (For short ‘Forum’) in C.C.No.463/2007 whereby the Forum has dismissed the complaint filed by the complainant/appellant.

2.                     Heard learned counsel for parties on IA-1, application filed under Order 41 Rule 27 of CPC along with photographs.

3.                     On going through the impugned order and the application filed under Order 41 Rule 27 of CPC along with documents, we are of the view that the fact which has been tried to be brought on record and which is disputed by learned counsel for the respondent needs to be examined by the Forum by giving opportunity to parties to establish their respective pleas by leading further evidence as per law.

4.                     In the circumstances, we set-aside the impugned order and remand the case to the Forum for deciding the complaint afresh in accordance with law.  Photographs filed along with IA-1 be sent to the Forum along with record of the case.  

5.                     Parties are directed to appear before the Forum on 10.02.2020.

6.                     With the aforesaid directions, the appeal stands disposed of.
