This Transfer Application has been filed by the Applicant/Complainant for the transfer of CC 101 of 2016 from District Forum, Birbhum to District Forum, Kolkata, Unit-I.

It has been submitted by the Learned Counsel for the Applicant that the complaint case was filed before the District Forum, Birbhum, but the Applicant being 80 years old has been suffering from old age ailments and he is now completely bed ridden.  It is submitted that the Complainant resides in Kolkata and it will be very convenient if the case is transferred from District Forum, Birbhum to District Forum, Kolkata, Unit-I.

The OP filed written objection against the petition for transfer of the complaint case, contending that the Complainant intentionally filed the application for transfer only to harass the OP.

We have heard the submission made by both sides and perused the papers on record.  The Complainant has filed the medical prescriptions in support of the contention of illness.  Having heard both sides and on perusal of the papers on record, we are inclined to allow the petition for transfer of the complaint case in the interest of justice. 

The Transfer Application is allowed.  The case no.CC 101 of 2016 pending before District Forum, Birbhum (Suri) is withdrawn and transferred to the District Forum, Kolkata, Unit-I for disposal.  Parties are directed to appear before the District Forum, Kolkata, Unit-I on 30/01/17.  The District Fora be informed accordingly.
