ORDER

The Complainant filed the present complaint case interalia stating that they had booked a Flat in Galactic City, Greater Noida, (West) and had made payment of Rs.20,00,000/- and since the possession was not handed over, they had filed the present case and  claimed Rs.34,00,808/- from the OP and OP had been contesting the matter since long however subsequently the parties have settled the matter and settlement deed has been placed on record dated 12.05.2023 by which the OP to pay Rs.32,05,647/- to the Complainant including interest @ 8% p.a. and the said amount would be paid by the OP as mentioned in the settlement deed which payment/installment would be running from 12.06.2023 to 12.07.2024.  The settlement deed bears the signature of complainant at point A and of the AR of OP at point B.  It is informed that both the parties would abide by the terms and conditions of the settlement deed.  Therefore, without referring any opinion on merit, the consent Decree is passed in terms of the settlement deed i.e. OP would pay to the complainant an amount of Rs.32,05,647/- out of which Rs.500000/- have already been paid by the OP to the Complainant by way of Cheque on 12.05.2023.  The terms and conditions of the settlement deed would form part of the Consent Decree and would be biding on both the parties.  Copy of Settlement Deed would form part of the Consent Decree .  The matter is disposed off with liberty to proceed in accordance with law if any of the terms and conditions are not complied with by the OP. 

No order as to cost/compensation.

Copy of this Judgment be given Dasti to both the parties.
