Suresh Kumar      Vs.    Hindustan Insurance Brokers Ltd.

 

Present:       Sh. Rakesh Kumar, Adv. for the complainant.

 

                   Complaint presented before the registry of this Commission on 22.02.2023 and put up before this Commission on today itself. It is hereby ordered to be registered against the registration number already allotted by the registry of this Commission.                         

                   Complainant attached documents Ex.C-1 to Ex. C-16 with the complaint.

                 From the perusal of the contents of the complaint, it is very much clear that neither the respondent No.2 being the insurance company concerned has repudiated the claim of the complainant or settled the same in any manner. Before proceeding further, it will be appropriate, if the respondent No.2 is directed to settle the claim of the complainant in time bound manner in either way and since, at this stage, no adverse order is being passed nor any order is being passed deciding the right of the parties. Therefore, the respondent is not required an opportunity of being heard at this stage.

              The opponent No.2 the New India Insurance Company Limited is directed to decide the claim case of the complainant by passing speaking order within the period of 40 days from the date of receipt of copy of this order. Thereafter, if the complainant is not satisfied with the decision of the respondent No.2 regarding repudiation of claim or partly acceptance of the claim etc., in that eventuality, complainant shall be at liberty to file afresh complaint before this Commission and in a fresh complaint, complainant will disclose the particulars of the present complaint and its fate. The complainant shall be responsible to deliver the copy of this order either by hand or through registered post or whatever another legal mode promptly to the respondent No.2 at his own responsibility. File be consigned to the records.
