No step is taken by the Complainant.

Step is taken on behalf of the O.P. through Ld. G.P., Bankura.

The case is fixed for argument.

After hearing argument the Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case is that he purchased one Lenovo K8 Note Mobile from Amazon India on online shopping site but the same was found defective on receipt after delivery and the defective Mobile was accordingly despatched to the Addressee by Speed Post service on 04-10-2017 but it was lost as per report of the concerned Postal Authority.

Hence, this case.

The O.P. contested the case by filing written version denying all the material allegations therein contending inter alia that the Postal authority has no liability for any loss or damage of any item in course of transmission by post and accordingly the case is not maintainable.

            Having regard to the facts of the case, written version, submission and materials on record the Commission finds that under Section 6 of the Indian Post Office Act, 1898 the Postal Authority has no liability for reason of any loss of any postal article in course of transmission by post. However the Postal Authority as per Post Office guide may consider on the request of the Addressee to pay compensation up to a limit of Rs.100/- only for the loss of any Inland letter pack or parcel or its contents in course of transmission by post to be claimant within three months from the date of booking of the article.

            In view of the statutory provision as above this Commission has no jurisdiction to award any compensation in this case as prayed for by the Complainant.

Hence it is ordered……

That the case is dismissed on contest but without cost.

Both parties be supplied copy of this Order free of cost.
