ORDER

 

 

During the arguments complainant admitted that the policy is issued from Etah, U.P. deceased Sunari Lal who is the husband of the complainant was also residing in the U.P. , claim was also filed in the U.P. Hence, complainant sought liberty to withdraw the matter and file it before appropriate Commission. Limitation, if any, is waved off  in view of Hon’ble Supreme Court judgment in Laxmi Engineering Works versus PSG Industrial institute (1995) 3 SSC 583. Heard allowed. Matter is dismissed as withdrawn. Let original copy of the complaint be returned after retaining a copy of complaint on record. File be consigned to record room.
