ORDER:
Today the case for fixed for arguments.
During the course of arguments, Shri D.K.Gosain, counsel for
the opposite party/HDFC Ergo has made a statement that “I have been authorized on behalf of opposite party/insurance company to settle this case upto 70% of IDV in full and final settlement. Company will make payment of the amount within 45 days from the date of order.”
Shri Nasir Khan, counsel for the complainant has made a statement that “I have heard the statement of the counsel for the OP/insurance company and I accept the offer made by the counsel for the company and received 70% of IDV value of the vehicle.”
On the basis of the statement of the counsel for the parties, the Commission is of the opinion that the complaint is disposed off with the direction to opposite party to pay 70% of IDV value of the vehicle in question in full and final settlement to the complainant, subject to the condition that the complainant will furnish the subrogation letter, cancellation of RC, affidavit, Form 29,30 and Form 35A. Compliance of this order be made within 45 days from the date of receipt of copy of order. File be consigned to the record room. Copy of this order be sent to the parties concerned free of costs.
