Complaint under Section 35 of Consumer Protection Act, 2019.

Present:  Sh. Ram Niwas, complainant in person alongwith Sh. Abhay Sahu, Advocate.

                Sh. Akansh Mehndiratta, Legal Officer of OP alongwith Sh. Amish Goel, Advocate.

                               

                Today the case is fixed for filing the reply to the application for rejecting the complaint and consideration on the stay application. However, both the parties stated at bar that the matter has been compromised. Hence, complainant as well as representative of the OP have recorded their joint statement with regard to the compromise, that the matter has been compromised with the OP, and as per compromise the complainant shall deposit an amount of Rs.8,65,000/- as full and final settlement in the loan account bearing A/c No.12101888 within two days from today, and on deposition of the said amount, the OP will release the vehicle in question to the complainant. The complainant is having one another loan account of tractor which is still in pending and the NOC pertaining to aforesaid loan account i.e. A/c No.12101888 as well as tractor loan shall be issued by the OP on clearance of both the loans. The parking charges shall be paid by the complainant to the yard owner.

         Complainant also suffered his separate statement to the effect that keeping in view the joint statement with regard to the compromise, he withdraws the present complaint.

                In view of the above statement, the present complaint is hereby dismissed as withdrawn being compromised. Both the parties would be governed by the statement made by their respective counsels. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
