The Appeal has been called out the second time.  Still, no one appears for the Appellant.  The Respondent/Complainant is present in person.

Vide order dated 13.04.2017, while issuing notice in the Appeal, we had granted an ad-interim stay of certain directions issued by the State Commission in the order impugned in the Appeal, subject to the Appellant’s depositing in this Commission the principal amount deposited by the Complainant with interest @ 10% p.a. from the date of each deposit till 31.03.2017, within eight weeks from the date of the said order.  On deposit of the said amount, the Complainant was permitted to withdraw the said amount, on filing an affidavit, undertaking to refund the amount withdrawn, if so directed, at the time of final disposal of the Appeal.

It is pointed out by the office that the Appellant has not made any deposit in terms of the said order.

In view of the above, while dismissing the Appeal for non-prosecution, we clarify that there is no stay of the order impugned in this Appeal and it will be open to the Complainant to have the same enforced in accordance with law.
