Learned counsel for the parties have moved joint compromise and as per compromise petitioner has agreed to refund entire amount with interest to the respondents in the name of Respondent No. 1 and petitioner will be entitled to get refund of amount deposited with District Forum in pursuance to order dated 28-01-2015.

          In the light of settlement, impugned order dated 17-10-2014 passed by learned State Commission in First Appeal No. 255 of 2014 – M/s Omaxe Ltd. & Anr. Vs. Harnam Dass Gupta through LRs is modified and petitioner is directed to make payment of decretal amount of Rs.7,79,298/- to the respondents with 8% p.a. interest from the date of respective deposits within 15 days after withdrawal of amount from District Forum deposited in pursuance to order dated 28-01-2015.  In case amount is not remitted to Respondent No. 1 within 15 days from the date of withdrawal of amount from District Forum along with interest accrued, if any, respondents will be entitled to get 12% p.a. interest on the aforesaid amount after the due date of payment.

          District Forum is directed to refund aforesaid amount to the petitioner along with interest accrued, if any.

          Petitioner is expected to get refund of amount from District Forum within two weeks from today.  Revision petition is accordingly disposed of as settled.
