Joint application alongwith Memorandum of Settlement dated 8.8.2012 has been filed by both parties and same is taken on record. As per Memorandum of Settlement (Ex.-C-I)executed between the parties; (i) Petitioner is permitted to withdraw the amounts deposited by it alongwith the accrued interest; (ii) Present settlement is without prejudice to the rights and contentions of the petitioner and (iii) Order of District Forum passed in this case be treated as peculiar to the specific facts and circumstances of the present case and not be treated as precedent for other matters. Further, as per the settlement, petitioner has handed over two cheques to the attorney of the respondent, one for the sum of Rs. 4 lacs and other for the sum of Rs.20,000/-, towards full and final settlement arrived between the parties. In view of the Memorandum of Settlement made between the parties, revision petition stands dispose of. Both parties shall be bound by the terms of the settlement. Parties shall bear their own costs.
