The 1^st Cheque of Rs.3.5 Lakh as per settlement deed has been encashed and remaining 5 cheques would be encashed by the end of June, 2023.  In nutshell the case of the complainant was that he had booked a Flat in the project of OP and since the project was not ready, complaint was filed, thereby demanding Rs.1586794/- from the OP with interest and also for harassment charges and legal charges.  Parties have now settled the matter for Rs.21,00,000/- in terms of settlement deed filed in the Commission by which OP is ready to pay Rs.21,00,000/- in 6 installments of Rs.3.5 Lakh each and last installment is payable on 24.06.2023 along with certain other conditions.  The first cheque has been encashed and it is assured that OP would make endeavour for encashment for all the PDCs. 

The matter is accordingly disposed off as settled in terms of the settlement deed which would form part of this order and both the parties are bound by the terms and conditions of the settlement deed.  In case any cheque is dishonored the complainant would be at liberty to get the matter revived or to file the Execution Petition.  This matter is being disposed by passing the consent decree.
