Pleadings of the complainant in brief

• The Complainant purchased a Tower fan paying Rs 2990/- from the Opposite Party. The fan developed some complaints after 9 months of purchase. When he contacted,  the Opposite Party over phone, they insisted the Complainant to take the fan to their shop for attending to the complaint under warranty which was against the terms and condition agreed  upon while purchasing the fan. Aggrieved by this the complaint is filed seeking refund of Rs 2990/- along with compensation for mental agony.
• Notice was served  to the Opposite Party. They did not enter appearance, hence was set ex-parte.
• The Complainant was continuously absent. He failed to file Proof Affidavit even after directions. Hence the complaint was taken for orders on merits.
• In the absence of Proof Affidavit and any documents to support his       pleadings, this Commission is not in a position to examine the merits of this Case.
• In the result the complaint is dismissed.
