Heard the submission of Ld. Counsel appearing for the Revisionist/Petitioner.
Perused the impugned order dated 13.06.2022 vide order no. 24.
It appears from the impugned order that the OP Nos. 1 & 3 prays for vacating the ex parte order but the said Petition could not be allowed by the Commission below because there is no provision to hear such matter.
Ld. Counsel for the Revisionists/Petitioners/OPs submits that they filed their W/V but they did not file any evidence on affidavit.
We are of the view as the case was proceeded ex parte in the Commission below, so an opportunity should be given to the Opposite Parties of being heard.
Accordingly, the Revision Petition being No. 108/2022 is allowed ex parte with a cost of Rs. 1000/- payable to the Respondent to give the OPs an opportunity to contest this case as District level.
Hence, the order of ex parte hearing of the District Commission is set aside.
Parties are directed to appear before the Commission below on 25.09.2024 and the Revisionists/Petitioners/OPs shall file the evidence on affidavit at the Commission on that date and the District Commission shall allow it.
The Ld. Commission below is directed to dispose of the case in accordance with law as early as possible without being influenced by any observations made by this Commission.
Hence, the Revision Petition is allowed and disposed of.
