This is a complaint filed under Section 35 of the Consumer Protection Act, 2019.
- The case of the complainant, in brief, is as follows:
On 17/06/2023 the complainant purchased a battery from the opposite party for a consideration of Rs. 300/-. The Samsung Phone was not working after using the new battery. The first opposite party opined it as a software issue. They were reluctant to give the bill also.When consulted with the authorized service centre of Samsung, it was found that the battery was an old one. Phone board was okay. When the complainant approached the opposite party, they were reluctant to pay back and they were ready to exchange. It culminated in a quarrel and the opposite party used some bad words against the complainant. Thus the complainant preferred a complaint in police on 23/06/2023. Though the police interfered in this matter, it was in vain. Complainant prays to get back the cost of battery Rs. 300/- from the opposite party and compensation.
- The opposite party was set ex-parte.
- The points that arise for determination in this complaint are; 1) Whether there was any deficiency of service on the part of the opposite party, as alleged?
2) Reliefs and costs.
- The complainant was examined as PW1 and Ext. A1 was marked.
- Heard.
- Point No.1: The complainant has filed affidavit in terms of the averments in the complaint and in support of the claim. Ext. A1 is the screenshot of the googlepay details done by the complainant to the opposite party for an amount of Rs. 300/- which was the price of battery.
- The evidence of PW1 stands unchallenged. The opposite party has not turned up to file version. The opposite party has not produced any evidence to disprove the averments in the complaint or to rebut the veracity of the documents produced and marked by the complainant. There is no contra evidence to disprove the claim of the complainant. The case of the complainant stands proved through the testimony of PW1 and Ext. A1. The complainant is entitled to get Rs. 300/- the cost of the battery. The act of the opposite party has resulted in mental agony and hardship to the complainant, for which, he is entitled to be compensated adequately. Considering the entire facts and circumstances, we are of the view that a sum of Rs. 1,000/- will be reasonable compensation in this case.
- Point No. 2: In view of the finding on the above point, the complainant is disposed of as follows;
- CC 391/2023 is allowed in part.
- The opposite party is directed to pay Rs. 300/-(Rupees three hundred only) as the cost of the battery to the complainant.
- The opposite party is directed to pay Rs. 1,000/- (Rupees thousand only) as compensation to the complainant.
- The order shall be complied with within 30 days of the receipt of copy of this order.
- No order as to costs.
