This is second complaint filed by the complainant seeking refund of the amount paid.

                   It is on record that earlier the complainant had filed a complaint before District Forum-II, U.T., Chandigarh relating to the unit, in question, wherein he sought possession of the said unit. The said complaint was allowed by the Forum vide order dated 30.09.2015, which order was modified by this Commission vide order dated 15.12.2015 passed in Appeal bearing No.291 of 2015 filed by the complainant to the effect that the Opposite Party was directed to hand over possession by 14.12.2016, failing which, the Opposite Party was directed to pay interest on the entire deposited amount @12% p.a. (simple) till the time of handing over the possession.

                   Under above judgment, the complainant continues to get benefit of delayed compensation amount, as referred to above. Now he has taken a summersault that the amount paid by him be refunded to him.

                   No case is made out. Hence, the complaint stands dismissed.
