NARESH KATYAL, JUDICIAL MEMBER:
Delay of 218 days in filing of this appeal stands condoned for the reasons stated in the application for seeking condonation of delay.
2. Challenge in this appeal No.1023 of 2017 has been invited by appellant/complainant to the legality of order dated 29.11.2016 passed by District Consumer Disputes Redressal Forum-Panipat (In short “District Consumer Commission”) in complaint case No.61 of 2014.
3. This appeal has been received by way of assignment dated 04.08.2023 of Hon’ble Principle Bench. It came up for hearing today before this Bench. Sh. Gurdep Singh, Advocate has filed his memo of appearance on behalf of appellant and made following statement:-
“Stated that: I am filing my Memo of Appearance, today on behalf of appellant. I have the instructions from appellant, as well as, from learned counsel appearing for appellant, whose Power of Attorney is already on record, to withdraw the present appeal, as the dispute arising in complaint/appeal has been amicably settled and written compromise dated 10.06.2023 is being placed on record.”
4. As flowing consequence, in the light of statement of learned counsel for the appellant, this appeal is hereby dismissed as withdrawn, matter being compromised between parties to this lis by way of written compromise dated 10.06.2023, so placed on record of this appeal. It is ordered accordingly.
5. A copy of this order be provided to both parties, free of cost, as mandated by the Consumer Protection Act, 1986/2019. This order be uploaded forthwith on the website of the Commission for the perusal of the parties. Appeal file be consigned.
