The complainant is absent on repeated calls.  None for the complainant is present and no steps is taken.  Cause as per order sated 20.08.2024 is not shown by the complainant. No E/chief is filed by the complainant in spite of specific order. Ld. Advocate for the OPs is present.

On scrutiny it appears that WV was filed by the OP-2 on 31.07.2023 and OP-1 filed their WV on 09.08.2023 and the matter was fixed on 11.10.2023 for filing E/chief and on 11.10.2023 the complainant has taken no steps and the matter was fixed on 12.12.2023 for filing E/chief by the complainant as last chance and on that date the complainant prayed for adjournment and the matter was fixed on 26.12.2023 for  filing E/chief by the complainant as special chance and on that date the complainant prayed for time again on 29.02.2024. It also reveals from the order dated 20.08.2024 as the complainant failed to file E/chief on that date the matter was fixed on 06.11.2024 for showing cause by the complainant on 06.11.2024 the complainant remained absent, even today the complainant failed to take steps till 01.00 p.m.

It is settled principle of law that without reception of evidence on affidavit, the matter cannot be decided.

In view of the above, it seems to us that the complainant is not at all interested to proceed with the Consumer Complaint.

Hence, it is

ORDERED

that the Consumer Complaint be and the same is dismissed for default.  No costs.
