Vide impugned order dated 28.09.2012, the appeal filed by the petitioner before the State Commission was dismissed in default due to non-appearance of the petitioner as well as the counsel. Heard. For the reasons mentioned in the revision petition, the revision petition is allowed and the impugned order passed by the State Commission is set aside and the appeal is restored, subject to payment of cost of Rs.10,000/-. Cost be deposited by way of demand draft in the name of Consumer Welfare Fund as per Rule 10 A of the Consumer Protection Rules, 1987. In case the petitioner fails to comply with the aforesaid directions within the specified period, the revision petition shall stand dismissed automatically without any further orders.
