This C.C. Case No. 03/2022 has been filed by the complainant, Harisankar Sahoo, Mobile No.7008713617 against the above addressed O.P. through “e-dakhil (Consumer Commission Online-Application) Portal”, Jajpur on dt.10.01.2022.
Brief facts of the case are that complainant had purchased a “Exicom E-Auto Charger” on dt.14.09.2021. but it’s not worked. The complainant send it to the above named company for repair the E-Auto Charger and such charger was repaired by the O.P’s company. Again the E-Auto charged faced some problem. The complainant stated that finally he had returned the said e-Auto Charger to the O.P. Company. It is also stated by the complainant that he had paid loan amount to E-Auto (Kinetic) Company regularly. But the complainant belongs to a poor family so it is very difficult to pay the loan amount. Hence, the complainant filed the consumer complaint with request to action against the O.P. Company, Company Manager (Arun Sir), Mob. No.8010019979 & Service Engineer (Uday Sir), Mob. No.9818072128. The claim amount in words Rs.9,500/- (Rupees nine thousand) only by the complainant. Thus, this is a fresh case filed by the complainant vide User Id : The complainant in support of his case has filed one Xerox copy of consigner copy from “United Cargo Logistics, vide Consignment Note : 3470 on dt.01.12.2021 bearing Transport Id : 88GLZPS9256N1ZK, Invoice No. EV-407 on declared Value of Rs.3,500/- (Rupees three thousand five hundred) only, Two xerox copies of “Whatsapp SMS” with Exicom Uday, on dt.25.11.2021 & 08.12.2021 and one Xerox copy of Courier Acknowledgment Receipt vide Sl. No.07 namely Exicom Tele System Ltd. with signature & Mob. No. 7683094092 on dt.17.12.2021.
On dt.11.02.2023 when the case is posted for “1st National Lok Adalat” none appeared on behalf of the complainant as well as O.P. for the purpose of amicable settlement between both the parties. After perusal of the order sheets it clearly shows that since dt.23.03.2022 till dt.06.05.2023 no steps has been taken by the complainant. Many dates have gone since dt.23.03.2022 and this Commission duly intimated the daily updated date through CONFONET specially for “e-filing/e-dakhil” to the complainant as well as the O.P. Company to appear before this Commission. But the complainant is not taking any steps to proceed with the case. It is also reveals that ”Notice” was issued on dt.06.02.2023 to the complainant & O.P. Company on the occasion of “1st National Lok Adalat” by post to attend the National Lok Adalat on 11.02.2023 but no steps has been taken by them. As a result of which the complainant remained absent till today after due intimation by this Commission and it seems that the complainant does not want to proceed with this case further.
Hence, the present consumer Complaint Case No.03/2022 is hereby dismissed due to non-prosecution and accordingly disposed of.
