The brief facts of the complaint case is that, the complainant has deposited a sum of Rs.3,322/- only before the O.Ps. for taking a new electric connection on dtd.22.04.2017. The O.s. have assured to give electric conection within 15 days but till date they have not given electric connection, hence this case.
On service of notice, the O.Ps appeared and filed Written Version through his counsel and submitted that the complainant is an unauthorized occupant and a stranger to the said Qr.No. A/45, OPM Colony, Brajrajnagar in which he has applied for a new electric connection. The O.Ps. are ready to retuned the deposited security money paid by the complainant and prayed for dismissal of the case.
Heard from the parties, gone through the case and materials available on record. The complainant had deposited Rs.3,322/- only on dtd. 12.04.2017 before the O.Ps. vide Money Receipt No.A9-9576126 for a new electric connection for his residential address Qr. No-A/45,OPM Colony, Brajrajnagar but one Sanjukta Mohapatra has objected before the O.Ps. as the said quarters number has been allotted in her favour by the concerned authority of Orient Paper Mills. The copy of agreement filed by the O.Ps. was executed by and between one Biranchi Narayan Purohit aged about 62 years who represented the Orient Papers & Industries Ltd.,Brajrajnagar being the licenser and one Miss Sanjukta Mohapatra aged about 47 years shows that the agreement executed and renewed on dtd. 06.08.2015 for a period of two years i.e. up to dtd. 06.08.2017. The agreement period is expired and no further renewed agreement has been filed by the O.Ps. Further the O.Ps. have failed to file any authenticity provided by the said Orient Papers & Industries Ltd.,Brajrajnagar to the said Biranchi Narayan Purohit. The O.Ps. if found the complainant to be non-eligible for getting new electric connection then they could not have received the charges amounting Rs.3,322/- only from the complainant or it could have returned to the complainant by any means but instead the O.Ps. have received the amount towards charges of new connection and not provided any new connection till date.
On the above mentioned facts and circumstances the O.Ps. are found to be deficient in their service, hence the complaint petition is hereby allowed with directing the O.Ps to give a new electric connection in the premises of complainant and pay a sum of Rs.500/- (Rupees five hundred) only to the complainant towards litigation costs within 15(fifteen) days from the date of receipt of this order.
Accordingly the case in hand is disposed of.
