Complainant is present and files Xerox copy of Orissa Electricity Regulatory Commission (Page-9 & 10) with regard to determination of Open Access Charges. Mr.Dey, the Authorised Representative of O.P. is present and files copy of Judgment the Hon’ble High Court, Odisha in W.P.(C) No.14030 of 2010 reported in OLR 2010(II) at page 720. Heard the case on the point of admission and perused the complaint petition and documents. While going through record, we do not find any document in favour of the Complainant that he is a consumer of electricity under the O.Ps nor he is a tenant of the so called Jitendra Barik against whom energy charges have been deposited. Under such circumstance, we are inclined to hold that the Complainant is not a consumer under the O.Ps. Accordingly, the case is rejected at the stage of admission.
