This C.C.Case has been filed U/s-35 of C.P.Act, 2019 and taken up today for order. We are disposing it as per mandate of C.P.Act, 2019.
We have gone through the Case Record and perused the entire order sheets and on repeated calls Complainant remained absent and the Adv. for Ops present. It clearly shows that since dt.04.03.2024, the Complainant remained absent and taking no step in this case. Even after due intimation by this Commission, the Complainant or his Counsel did not turn up to proceed with the hearing in this case. It seems that the complainant is not interested to proceed further in this case.
That apart the C.C. Case relates to the matter involves U/s-126 & 135 of Electricity Act, 2003. As per the decision of Honbl’e Apex Court in the case of State of U.P. Power Transmission Corporation & others vrs Md. Anis Ahmed and so also of our own High Court in WP(c) No. 1704/2020, the present C.C.Case is not maintainable before this Commission.
With the aforesaid observation the C.C.Case No. 207/2023 is hereby dismissed and accordingly disposed off. No order as to cost.
Issue extract of the order to the parties concerned.
