HON’BLE JUSTICE SRI.S.S.SATHEESACHANDRAN : PRESIDENT

Complainant has filed the appeal challenging the order of the forum dismissing his compliant for default. On the hearing date complainant remained absent and, thereupon the complaint was dismissed. Dismissal of compliant for default will not debar complainant from filing a fresh complaint on the same cause of action explaining the delay, if any, in filing such complaint. Needless to point out time taken for prosecuting the appeal before this Commission can be sought to be exempted invoking the appropriate provision of law of limitation before the forum in case the complainant desires to move a fresh complaint. Subject to the observations made above, the appeal is dismissed.
