  1.      Briefly stated, the facts of case as alleged by the complainant are that  he purchased two booth sites measuring 20 sq. yards in September, 2014 from Sh.Jang Singh s/o Bachan Singh and Puneet Puri s/o Sh.Mangat Rai Puri.  He paid Rs.80,000/- as transfer fee to OP.  The LOIs were issued in December 2014 and January, 2015 in his favour.  The complainant personally visited several times to the OP but no positive response received till date.  It has further been averred that almost seven years have elapsed but there is no allotment or construction by the GMADA and he suffered a lot financially and faced mental hardships.  The complainant has filed the instant complaint with a prayer that the OP be directed to pay interest @ 18% p.a. on the deposited amount, compensation etc.
  2.      Despite due service through registered post, the Opposite Party failed to put in appearance and as a result thereof it was ordered to be proceeded against exparte vide order dated 17.01.2022.
  3.      We have heard the Counsel for the complainant and have gone through the documents on record.
  4.      The facts on record shows absolutely indifferent attitude of the GMADA authorities towards the complainant in case, the allotment letters pertaining to the LOIs of the area in which the LOIs of the complainant falls have been issued, then the GMADA authorities are bound to issue the allotment letters to the complainant as well.  The request of the complainant for issuance of the allotment letter with regard to the LOIs in question was never paid any attention which caused lot of nervousness, insecurity and mental harassment to the complainant who spent hard earned money to buy two commercial plots for which the GMADA authorities issued proper LOIs in his favour.
  5.      In view of the above discussion, the present complaint is disposed of with direction to the OPs to issue the allotment letter(s) with regard to the LOIs in question, in case, the allotment letters pertaining to the LOIs of the area in which the LOIs of the complainant falls have been issued, within a period of three months from the date of receipt of this order.
  6.      Certified copy of this order be communicated to the parties, free of charge. After compliance file be consigned to record room.
