ORDER

Heard counsel for the petitioner. The State Commission has very rightly considered all the relevant materials and has come to the conclusion that extra amount charged as the land price which was applicable in the case of allotment of one Jogi Ram three years back in the year 1995, cannot be applied in respect of the allotment made to the Complainant in the year 1998 because interest was calculated upto-the-date of allotment in each case. The State Commission has relied upon a circular and instructions of Housing Board. The flat was allotted at a tentative price and subsequently on account of allotment of a house in lieu of the original house to the complainant additional extra amount was demanded on account of corner plot, enhanced land cost and price of extra land. In the facts and circumstances, the order of the State Commission is just, fair and equitable and does not call for interference in revisional jurisdiction under Section 21(b) of Consumer Protection Act, 1986, as we do not find any jurisdictional error, illegality or material irregularity in the order of the State Commission. The revision is, therefore, dismissed with no order as to costs.
