The case  of the complainant is that,  
 
The complainant was a Chitty subscriber having sala of Rs.1,00,000/- in a Chitty Company run by the opposite parties. The Chitty was for 20 months with monthly instalments  of Rs.5000/- which is starting from 17/01/2014.  As per the terms and conditions mentioned in “Variola” the complainant remitted the

first instalment on 15/02/2014 and the remaining instalments after deducting veethapalisa, as per the  norms of said chitty and thereafter she paid 18 instalments without any default or dues, as per the norms of the chitty.  The instalments are collected on daily basis which was recorded in the pass book by the collection agent.  The monthly amount was verified and signed by the manager or field officer.  An amount of Rs.17,000/- collected by the fifth opposite party collection agent was not properly accounted in the pass book.  The entire chitty instalments are remitted by the complainant.  Opposite parties made the complainant to believe that, those who did not bid the chitty in auction would receive full amount of chitty after deducting foreman commission.  The complainant did not bid the chitty in auction and she remitted the full  instalments also.  Now the opposite parties are not cared to repay the chitty amount as agreed.  In spite of the repeated demands, the opposite parties are not turned up to pay the chitty amount.  Notice served to opposite parties.  They appeared before this Forum.  But they did not file version or any evidence adduced by them.  So they set ex parte.
 
The point for consideration is whether there was any deficiency in service from the part of the opposite party, and if so, for what relief the complainant is entitled to?  
 
The complainant adduced evidence by way of proof  affidavit.  Ext.P1 was marked.  Ext.P1 is the copy of pass book and variola.  The opposite parties did not take any evidence against the complaint.
 
The Point:-   The complainant alleges that, the opposite parties are not turned up to pay the chitty amount.  The complainant has adduced evidence and produced documents.  But opposite parties  are not produced any evidence.  The complainant produced the copy of chitty pass book and variola before this Forum.  It was marked as Ext.P1.  But the opposite parties did not file version.  So they set ex parte.
 
Hence petition allowed.  The Forum directs the opposite parties to pay the chitty amount of Rs.1,00,000/- in chitty No.13 with 12% interest from the date of last instalment till realization and also direct the opposite parties to pay

Rs.5,000/- as damages and Rs.2,000/- as cost of the petition within 30 days of the receipt of the copy of this order, failing which this amount shall carry 12% interest per annum from the date of default.
