At the time of arguments, dispute has amicably been settled between the parties.
On getting instructions from Sh. Subrat Kumar Pradhan, DGM (Legal) of the Opposite Parties, Sh.Sanjeev Sharma, Advocate, Counsel for the Opposite Parties states that Opposite Parties will return amount paid by the complainants i.e. Rs.41,05,275/- with interest @12% p.a. (simple) from the date of respective deposits made. He further states that to settle dispute, the Opposite Parties shall also pay an amount of Rs.1,00,000/- towards compensation to the complainants.
Sh. Vipin Mahajan, Advocate on getting instructions from Sh.Sunil K.Goel & Ms.Neeta Goel, complainants, accepts the aforesaid proposal made and further states that the criminal complaint filed by the complainants, now pending before the Court of Chief Judicial Magistrate, Chandigarh shall be withdrawn on the next date of hearing.
On account of above, it is agreed by Counsel for the Opposite Parties that 50% of the amount shall be paid to the complainants within a period of one month and the remaining 50% of the amount shall be paid to the complainants within two months thereafter. It is made clear that the period of three months will start from withdrawal of the criminal complaint.
It is directed that in view of ratio of judgment dated 20.11.2015 passed by this Commission in the case titled as ‘Shri Ajay Gauba Vs. Parsvnath Developers Limited, Execution Application No.87 of 2015’, the TDS be not deducted.
In view of consensus arrived at between the parties, this complaint stands disposed of.
