ORDER

Counsel for the parties are in agreement that the matter has amicably been settled.

                        Sh. Ashim Aggarwal, Advocate, on getting instructions from Sh. Gurdeep Singh, Senior Manager (legal) of the Opposite Parties states that an amount of Rs.39,09,851/- shall be returned to the complainants and to compensate them, interest will be paid @12% per annum (simple) from the dates of respective deposits made. Interest @12% per annum (simple) will be calculated till today i.e. 09.09.2016. It is further stated that the amount due shall be paid through a demand draft within 30 days from today.

                        It is directed that in view of ratio of judgment dated 20.11.2015 passed by this Commission in the case titled as ‘Shri Ajay Gauba Vs. Parsvnath Developers Limited,’ Execution Application No.87 of 2015’, the TDS be not deducted.

                        In view of above settlement, this complaint stands disposed of.

                        It is made clear that in case, commitment is not honoured by the Opposite Parties, the order shall be treated as an executable decree and the complainants will be free to execute it as per laws.

                        Certified copies of the order be sent to the parties free of charge.
