Counsel for Opposite Parties No.1 and 2 has raised objection qua pecuniary jurisdiction of this Commission to entertain this complaint. To support his contention, he has placed reliance upon the ratio of judgment passed by Hon'ble National Consumer Disputes Redressal Commission, New Delhi in the case of AMBRISH KUMAR SHUKLA & 21 ORS. Vs. FERROUS INFRASTRUCTURE PVT. LTD., Consumer Case No.97 of 2016, decided on 07.10.2016.
We have perused the documents. It is apparent on record that value of the product/Villa is more than Rs.1 crore.
Faced with the situation, Sh. Gaurav Bhardwaj, Advocate appearing as proxy for Sh. Paras Money Goyal, Advocate, Counsel for the complainants states that the pleadings are complete and the matter is at the final stage i.e. for arguments. He further states that let this complaint be transferred to the Hon'ble National Consumer Disputes Redressal Commission, New Delhi for adjudication.
Since the proceedings are at the final stage, to avoid inconvenience to the parties to complete the pleadings again, the prayer is granted. All the questions/objections raised by both the parties in this complaint and the reply filed shall remain open.
Accordingly, it is ordered that the complaint case, in original, (3 copies) be sent to Hon'ble National Consumer Disputes Redressal Commission, New Delhi for taking further necessary action. One copy of complaint (complete paper-book) be retained for record of this Commission.
The parties are directed to put in appearance before the Hon'ble National Consumer Disputes Redressal Commission, New Delhi on 11.01.2017.
Certified copies of this order be sent to the parties free of charge.
