Today is fixed for effecting compromise, if any, i.d., taking fresh step upon OP No. 2 by the complainant and for filing W/V by OP No. 1.
Today complainant files an application through his ld. Advocate supported by affidavit stating that during pendency of this case out of court amicable settlement has been done and the grievance of the complainant has been solved. Therefore, the complainant has no dispute further and he is not willing to proceed with this complaint further and prays for dispose of the present case for non-prosecution, otherwise, the complainant will suffer irreparable loss and injuries.
The copy of the said application is received by the other side. Ld. Counsel for the OP No. 1 is also present by filing hazira and also files a photocopy of email, wherefrom it is evident that the ‘matter has been settled’ by and between the parties out of this Commission.
As the complainant by filing application through affidavit submitting that the grievance has been solved and complainant has no dispute further against the Ops, he prays for disposing of the present complaint for non-prosecution, we are inclined to pass order in favour of the complainant.
Hence, it is

that the present Consumer Complaint being No. 161/2019 be and the same is dismissed for non-prosecution. There is no order as to costs.
Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
