Present:-  Complainant in person.

        Heard. In General Manager, Telecom Vs. M. Krishnan and Anr. Civil Appeal No. 7687 (2004) JT2009(11)SC690, which has been followed by Hon’ble National Commission in Modi Textile Agencies Vs. Mahanagar Telephone Nigam Ltd. Revision Petition No. 2107 of 2005, decided on 11.11.2009, it has been held that when there was a special remedy provided in section 7(B) of the Indian Telegraph Act regarding disputes in respect of the telephone bills, then the remedy under the Consumer Protection Act by implementation was barred.  Again in Prakash Verma Vs. Idea Cellular Ltd. & Anr. Revision Petition No. 1703 of 2010, decided on 21.05.2010 by Hon’ble National Commission, it has been held that “any dispute” between the subscriber and the telegraph authority can be resolved by taking recourse to arbitration proceedings only.”

2.     In view of the decision refer to above this forum does not have authority to entertain the present complaint.  Complainant submits that he may be allowed to withdraw the complaint with liberty to take any other appropriate remedy to vindicate his right.  Complaint is, therefore, dismissed as withdrawn, liberty as prayed for granted.  Copy of this order be given to the complainant.  File be consigned to the record room.
