Record is put up today. The Judgement Debtor has filed hajira through his Ld. Advocate. The Ld. Lawyer for the Decree Holder. is also present. The Judgement Debtor has filed a petition praying for dropping the present Execution Application. The Judgement Debtor has also filed one photocopy of the Final order dt. 07/07/2017 passed by the Hon’ble State Commission, West Bengal in First Appeal no. FA/545/2013 arisen out of order dt. 12/04/2013 in connection with CC/05/2012. Perused the petition filed by the Judgement Debtor and the photocopy of the order passed by the Hon’ble State Commission, West Bengal. Heard both sides. From the order passed by the Hon’ble State Commission, West Bengal, we find that the Hon’ble State Commission, West Bengal has been pleased to set aside the judgment and order passed by this Forum on 12/04/2013 in connection with CC/05/2012. Therefore there is no ground to proceed further with the present Execution Application. Accordingly the present Execution Application is liable to be dropped. The petition filed by the Judgement Debtor is considered and stands allowed. Hence it is ,

that the Execution Application no. 16/2013 be and the same is dropped. The case is thus disposed off.
