On call, no one turned up on behalf of complainant. It is relevant to mention at the outset that this case was brought on account of Medical Negligence as stated by the complainant in the complaint that due to negligence of Opposite party his mother died. Hence, after considering the facts involve for proper appreciation, it was sent to Civil Surgeon to constitute a Medical board and to provide expert opinion relating to the points of negligence by the doctor under treatment as stated by the complainant. In compliance thereof, Civil Surgeon Patna had constituted a team of five doctors including him as a Chairman of the committee and submitted report, which bears dated 02.11.2022. Of course, after going through the report it appears that final opinion has been given which reads as follows “we opine that the Treatment and Management at Paras HMRI(the Opposite Party) were at standard norms. There is no evidence of any Professional Negligence & Deficiency in Service on part of Paras HMRI, the opposite party”.

          An opportunity to the complainant for  hearing has been given after receipt of the report of the expert but complainant perhaps after receipt of the report has become disinterested and did not turn up for any objection against report. After careful scrutiny by this District Commission, upon the expert opinion we find that the doctors who have participated in the medical board had categorically examined each and every aspect. Under the aforesaid discussion and reason, we do not think proper to issue notice against the opposite party. Hence, this complaint petition stands dismissed without its admission.
