State Commission, while admitting the appeal, has directed the Petitioner to refund the entire amount deposited by the respondent.  Being aggrieved, Petitioner has filed the present revision petition contending that refund of the entire amount deposited by the respondent would frustrate the very purpose of filing the appeal.

        Mr.Ravindra Kumar Sharma, Advocate accepts notice on behalf of the respondent.

        Counsel for the Petitioner states that the Petitioner has already deposited Rs.20,000/- with the State Commission and shall deposit the balance decretal amount within 2 weeks from today. 

        Direction issued by the State Commission that the amount be paid to the respondent is set aside and instead the State Commission is directed to keep the amount in continuing fixed deposit till the disposal of the appeal.  At the time of disposal of the appeal, State Commission shall pass the necessary order regarding disbursal of the amount.

        Subject to the modification indicated above, revision petition is dismissed.
