An account payee Bankers Cheque bearing no.909415 amounting to Rs. 1,25,000/- (Rs. One Lakh Twenty Five thousands only) has been filed on behalf of Jdr. said Bankers cheque has been drawn in favour of Swapan Garai / Dhr. in compliance with the order passed by Hon’ble State Commission, W.B. in connection with F.A. no.778 of 2012.

On the other hand Dhr. files copy (Xerox) of order dated 16-10-2015 passed by Hon’ble State Commission in connection with F.A. 778 of 2012 and pray for making order the said cheque to him.

Ld. Advocate for Dhr. is also present.

Heard. Perused the copy of order dated 16-10-2015 of Hon’ble State Commission. It appears that Hon’ble State Commission has been pleased to pass the following order "The Appeal is allowed in part. The Appellant is directed to pay compensation of Rs. One Lakh and Litigation Cost of Rs.25,000/- to the Respondent / Complainant within 60-days from this date saying with simple interest @ 9% p.a. shall accrue on the aforesaid amount from date of default till realization, other direction passed by Ld. District Forum are set aside. Impugned Judgement stands modified accordingly".

So it is clear to us that Jdr. has made deposit of Bankers cheque amount to Rs.1,25,000/- drawn in favour of Dhr. in compliance with order of Hon’ble State Commission.

On the other hand Dhr. has made prayer to make over said Bankers Cheque to him and has made prayer to dispose of this E.A. ca se with full satisfaction.

In view of prayer made by Dhr. Bankers Cheque no.909415 dated 19-05-2016 amounting to Rs.1,25,000/- drawn in favour of Swapan Garai / Dhr. be made over to him on his proper identification and Receipt. Let Xerox copy of Bankers Cheque be kept with this record.

This execution case is also disposed of with full satisfaction on the basis of prayer made by Dhr.
