In this application, applicant has prayed that:- “It is therefore prayed that this Hon’ble Commission may be pleased to direct that apart from Rs.2,50,000/- released to the applicant in the Hon’ble Commission towards payment of amount due a direction may be given to release/pay Rs.25,000/- towards costs from the statutory deposit and the balance statutory deposit by the appellant in the Hon’ble Commission be released to the applicant towards payment of the amount due to the applicant instead of refund to the appellant and the appellant be further directed to pay to the applicant the further balance of amount of Rs.2,93,053.20 paisa remaining due and payable to her immediately.” Learned counsel for the applicant states that he restricts his prayer in present application, with regard to the withdrawal of Rs.25,000/- of the costs only, which were imposed upon the appellant/non-applicant, while dismissing the appeal on merit. Costs of Rs.25,000/- imposed upon the non-applicant/petitioner, be paid to the respondent No.1/applicant, Dr. Kirtimalaviya. Application stands disposed of. |
